These Terms of Service ("Terms") govern your access to and use of our website (abbotworks.com), products and services (collectively, the "Services"). By using the Services or providing your contact information, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

2. Eligibility & Customer Responsibilities

Business Use: Our Services are intended for business‑to‑business communication. You represent that you are authorised to act on behalf of a business customer and are at least 18 years of age.

Consent for Communications: By providing your mobile number or other contact information, you consent to receive communications (including SMS, email and voice calls) from ABBotWorks regarding account management, service updates, marketing and promotional messages. Message frequency varies by user. Standard message and data rates may apply. You may opt out of SMS messages at any time by replying "STOP" or "UNSUBSCRIBE." For help, reply "HELP" or contact [email protected].

Accurate Information: You agree to provide accurate, current and complete information when creating an account or communicating with us. You are responsible for keeping your contact information up to date and for any use of the Services through your account.

3. Account Registration & Security

You may need to register for an account to use certain Services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use or security breach. We may suspend or terminate your account if we suspect fraudulent or abusive activity or if you violate these Terms.

4. Use of Services

Permitted Use: You may use the Services solely for legitimate business purposes and in compliance with applicable laws, including the Telephone Consumer Protection Act (TCPA), the Cellular Telecommunications Industry Association (CTIA) Messaging Principles and Best Practices, and A2P 10DLC rules. You agree to honour all opt‑in and opt‑out requests from end users.

Prohibited Content and Conduct: You agree not to send or facilitate the sending of any messages that are harmful, abusive, misleading, harassing, defamatory, excessively violent, deceptive, fraudulent, or that invade privacy or threaten consumers. You may not use the Services to send malware, phishing messages or unlawful content, or to spam recipients. The Services must not be used to promote gambling, alcohol, controlled substances, or other prohibited industries, nor to target minors without proper age‑gating.

Compliance with Consent Standards: You will only send messages to recipients who have provided valid consent and will provide clear opt‑out instructions (e.g., reply "STOP") in every campaign message as required by industry guidelines.

5. Payments and Commissions

If you purchase products or services from us or act as a sales representative:

Setup Fees & Recurring Charges: Customers pay a setup fee for configuration and onboarding. Representatives may earn 50 % of setup fees and a 20 % recurring monthly commission for up to 12 months.

Commission‑Only Representation: If you work with ABBotWorks as a sales representative, you acknowledge that compensation is commission‑based. Commission payments may vary based on collected fees and customer retention.

No Warranties of Revenue: We do not guarantee any level of income or specific number of leads. All commission payments are contingent on actual revenue collected.

6. Intellectual Property

The Services and all related software, trademarks and content are owned by ABBotWorks or its licensors. You may not reproduce, modify, distribute or create derivative works without our written permission. You retain ownership of any data you upload to the Services. By submitting feedback or suggestions, you grant us a non‑exclusive licence to use that feedback for any purpose without compensation to you.

7. Third‑Party Services

The Services may integrate with or allow you to access third‑party services (e.g., telecommunication carriers, payment processors). Your use of those services is governed by the third parties’ terms and privacy policies. ABBotWorks is not responsible for third‑party services and does not guarantee they will remain compatible with the Services.

8. Disclaimers and Limitation of Liability

No Warranty: The Services are provided on an "as‑is" and "as‑available" basis. ABBotWorks makes no warranties, express or implied, regarding the Services, including any warranties of merchantability, fitness for a particular purpose, title, or non‑infringement. We do not warrant that the Services will be uninterrupted, secure or error‑free.

Limitation of Liability: To the maximum extent permitted by law, ABBotWorks will not be liable for any indirect, incidental, special, consequential or punitive damages or for any loss of profits, revenues, or data resulting from your use of the Services. Our total liability to you for any claim arising out of or relating to these Terms or the Services is limited to the amount you paid us (if any) in the 12 months prior to the event giving rise to the claim.

9. Termination

We may suspend or terminate your access to the Services at any time for any or no reason, including if you violate these Terms, if required by law or if we discontinue the Services. You may terminate your account at any time by contacting us. Upon termination, your right to use the Services immediately ceases, but sections that by their nature should survive (e.g., intellectual property provisions, indemnity, limitation of liability) will remain in effect.

10. Changes to Terms

We may update these Terms from time to time. We will post the revised Terms on our website and update the "Last updated" date. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Services.
